A judge has ruled in favor of Sony and Dr. Luke in their ongoing legal battle with Kesha, as all but one of her counterclaims against Luke has been dismissed.

New York Supreme Court Justice Shirley Kornreich has ruled that the claims Kesha brought against Dr. Luke -- which accuse him of years of ongoing physical and emotional abuse -- cannot be further examined by the court, as the alleged incidents took place outside of New York. She further ruled the statute of limitations for an alleged 2008 incident is up, according to The Hollywood Reporter.

Kornreich also denied Kesha’s claims that Dr. Luke’s alleged abuses count as a hate crime against the singer. The judge wrote, “Every rape is not a gender-motivated hate crime.”

The ruling continued (via TMZ), "Although [Dr. Luke’s] alleged actions were directed to Kesha, who is female, [her claims] do not allege that [Luke] harbored animus toward women or was motivated by gender animus when he allegedly behaved violently toward Kesha."

Kornreich also ruled that a hate crime cannot be determined based on verbal abuse or threats, unless a physical assault is also involved, as "insults about her value as an artist, her looks, and her weight are insufficient to constitute extreme, outrageous conduct intolerable in civilized society."

The judge further sided with Sony by saying Kesha was not forced to work specifically with Dr. Luke, a ruling that echoes Kesha's denied injunction from earlier this year.

The devastating news comes days after Kesha said she was offered “freedom” from her Sony contract under the condition she recant the rape allegations she made against Dr. Luke.

"So. I got offered my freedom IF i were to lie,” she wrote in an Instagram post.

“I would have to APOLOGIZE publicly and say that I never got raped,” she continued. “THIS IS WHAT HAPPENS behind closed doors. I will not take back the TRUTH. I would rather let the truth ruin my career than lie for a monster ever again.”
