  • Learning & decision-making – Studying, planning trips, budgeting, or choosing products.

There are many ways for someone to use an AI tool.  However, with every great tool comes a potential for misuse.  In this particular case, a Texas man went way past acceptable and into illegal.

How a Texas Man Misused AI Tools

Brownwood, Texas resident Daniel Weatherly was recently sentenced to two years in federal prison, pleading guilty to creating and possessing illegal AI-generated content involving minors.

According to court records, Weatherly used an AI application to create images that inappropriately depicted children. Weatherly used specific prompts through AI to create these explicit images of children aged between 5 and 8 years old.

He pleaded guilty to the charges on January 8, 2025, and was sentenced on August 5, 2025.

In Texas, the penalty for possessing material involving sexual exploitation of minors can range from two to ten years in prison with fines up to $10,000, and registration as a lifetime sex offender.

When it comes to this kind of crime, AI-created or real, should judges be handing out harsher punishments? Two years seems like a very light sentence considering the seriousness of the offense.  Hopefully, Weatherly won't be able to use electronic devices or any type of AI software upon his release.

Could AI Crimes Lead to Tougher Laws?

They have, Senate Bill 20, appropriately named the Stopping AI‑Generated Child Pornography Act, was passed in March and goes into effect on September 1, 2025. This new law makes it a felony to possess, promote, or produce obscene visual material that appears to depict a child under 18, including AI-generated images, cartoons, or animations.
